Privacy Agreement Between Active and City of San Rafael
Both parties agree to use collected information in compliance with (a) all applicable laws, rules and regulations, including, without limitation, those governing privacy and personal information (e.g., by including an appropriate CAN-SPAM Act and Canadian Anti-Spam Legislation opt out mechanism in email communications) and the use of credit card data (e.g., using credit card information only for purposes authorized by the cardholder); (b) applicable credit card network rules and Payment Card Industry Data Security Standards; and (c) Active’s privacy policy, as published on its website or otherwise provided by Active from time to time. Notwithstanding any contrary provision of Active’s privacy policy or this Agreement, all data and information generated, collected, developed, discovered, or otherwise saved in the System exclusively for the Client (collectively the “Data”) by Active in the performance of this Agreement are confidential and must not be disclosed to any person except as authorized by Client or as required by law, with the exception of employees of Active, Global Payments, or our authorized users or partners in the service of providing support or services to the Client or associated End User.

City of San Rafael rules and regulations exist to ensure that government is open and that the public has a right to access appropriate records and information possessed by City government. At the same time, there are exceptions to the public's right to access public records provided by City, State and Federal laws. These exceptions include the privacy of individuals. Information collected at this site becomes public record and may be subject to inspection and copying by the public, unless an exception in law exists.

Information That May Be Collected And How It May Be Used
If you do nothing during your visit to the City of San Rafael Web site but browse or download information, we may automatically collect and store the following information about your visit:

1. E-mail correspondence: The e-mail address and contents of the e-mail;
2. Forms and Surveys: Any information you volunteered in response to the form or survey.
The information collected may not be limited to text characters and may include audio, video, and graphic information formats you send us. The information is retained in accordance with the City of San Rafael rules and regulations.
We may use your email to respond appropriately. This may be to respond to you, to address issues you identify, to further improve our web site, or to forward the email to another agency for appropriate action. Form and Survey information would be used for the purpose designated.
Personal Information and Choice
"Personal information" is information about an individual that is readily identifiable to that specific individual. Personal information includes personal identifiers such as an individual's name, address, and phone number. A domain name or Internet Protocol address is not considered personal information.
We will not collect personal information about you unless you voluntarily participate in an activity that asks for information (i.e. sending an e-mail, filling in and sending a form, or participating in a survey). If you choose not to participate in these activities, your choice will in no way affect your ability to use any other feature of the City's Web site.
If personal information is requested on the web site or volunteered by the user, City rules and regulations, the State's Information Practices Act of 1977 or the Federal Privacy Act of 1974 may protect it. However, this information is a public record once you provide it, and may be subject to public inspection and copying if not protected by above-mentioned legal references.
Users are cautioned that the collection of personal information requested from or volunteered by children on-line or by email will be treated the same as information given by an adult and may be subject to public access.
