Hold Harmless Clause: The undersigned agrees to indemnify and hold harmless, District, its officers, agents and employees from and against any and all claims, demands, losses, defense costs, or liability of any kind or nature which the District, its officers, agents and employees may sustain or incur or which may be imposed upon them for injury to or death of persons or damage to porperty as a result of, arising out of, or in any manner connected with my organization's performance under the terms of this contract, excepting only liability out of the negligence of the District.
Statement of Information: The undersigned states that to the best of his/her knowledge, the school property for use of which application is hereby made will not be used for the commission of any act which is prohibited by law, or for the commission of any crime including, but not limited to, the crime specified in Sections 11400 and 11401 of the California Penal Code. I certify (or declare) under the penalty of perjury that the foregoing is true and correct.
Sections 11400 and 11401 of the California Penal Code specifically referred to are the California Criminal Syndication Act which prohibits and penalizes advocacy of teaching, aiding or abetting acts intended to accomplish change in industrial ownership, or government by means of unlawful force, violence, or terrorism.
Statement of Responsibility: The undersigned hereby certifies that he has read the guidelines for use of District facilities listed below and shall be personally responsible, on behalf of his organization, for any damage or unnecessary abuse of school buildings, grounds,or equipment growing out of occupancy of said permises by his/her organization. He/she agrees to abide by and enforce the rules and regulations governing the non-school use of buildings, grounds, or equipment.
Guidelines for Application/Use of Arcadia Unified School District Facilities:
Please read these guidelines carefully before executing the Request for Use of District Facilities:
1. Any person applying for the use of school property on behalf of any society, group, or organization shall be a member of the applicant group. Unless he/she is an officer of the group, the applicant shall have written authorizaton from the group to make the application.
2. Juvenile organizations shall have adult sponsorship and supervision during use of school facilities.
3. Application for use of school facilities must be submitted annually.
4. Proof of insurance must be provided before using District facilities. The current requirement is a $1,000,000 policy per occurrence, with no deductible. A certificate of insurance and a separate insurance endorsement page listing Arcadia Unified School District as an additional insured must be provided annually.
5. There shall be no smoking in or about the school buildings, fields or premises at any time.
6. No intoxicating liquor or narcotics shall be used on school premises and violation of this regulation may cause denial of future use of school facilities to sponsoring organizaton at which such occurs.
7. Sunflower seeds are prohibited in or about the buildings, fields, and premises at any time.
8. School furniture and/or equipment may not be removed or displaced without permission from and under the supervision of the school district employee in charge.
9. Any permit may be revoked by the Assistant Superintendent, Business Services, for any organization that fails to use the facility as scheduled for three consecutive times. No refund will be made for no-shows.
10. In the event this permit is canceled by the applicant, no refund will be made and changes in date or extension of time shall be made only as specified in the agreement for use of school facilities or as specified by Board policy.
11. Any permit may be revoked or a change of location issued where conflicting dates have resulted or where the need of the property for public school purposes has subsequently developed.
12. The school district shall assume no responsibility for mail of a non-school group and shall not permit the use of the school telephone or school mail by any group or representative thereof.
